To ask the Scottish Executive how many deaths in the NHS Lothian area were (a) alcohol and (b) drug related and, of these, how many were of people aged (i) under 18, (ii) 18 to 29, (iii) 30 to 55 and (iv) over 55, from 1999 to 2008.

The total numbers of alcohol-related deaths in the NHS Lothian area, in each year from 1979 to 2007, are given in table 2 of the Alcohol-related deaths section of the web site of the General Register Office for Scotland (GROS), which can be found at this address http://www.gro-scotland.gov.uk/statistics/deaths/alcohol-related-deaths/index.html. The corresponding figure for 2008 is, provisionally, 168 (a number which could be revised in the coming months: the final figure for 2008 will not be available until August 2009).

The total numbers of drug-related deaths in the NHS Lothian area, in each year from 1996 to 2007, are given in Table HB1 of Drug-related deaths in Scotland in 2007, which was published by GROS in August 2008 and can be found on the GROS website via this address http://www.gro-scotland.gov.uk/statistics/publications-and-data/drug-related-deaths/index.html. The corresponding figure for 2008 will not be available until August 2009.

The following tables give the numbers of alcohol and drug-related deaths in the NHS Lothian area, for the age-groups and years requested, to the extent that they are available at present. GROS produced these figures by applying the same definitions as it used to prepare the tables which are referred to above.

To ask the Scottish Executive how much has been collected in the Lothians region in fiscal fines imposed since the implementation of summary justice reforms and in how many cases (a) no payment has been made and (b) payments are overdue.

From the 4,539 fiscal penalties registered and accepted (including deemed acceptance) between 10 March 2008 and 31 December 2008 with a value of £493,000 in the Sheriffdom of Lothian and Borders, Scottish Court Service (SCS) has collected £173,000.

67% of all fiscal penalties have been either paid in full or in part. Where any payments have fallen into arrears, SCS will take enforcement action to bring payments back on track. Of the 4,539 fiscal penalties 2,533 (56%) have been fully paid or are within agreed arrangements. A further 529 (12%) have had instalments paid but fallen into arrears. 1,477 (32%) have not been paid and are being targeted for enforcement action.

The percentage rate as to accounts in arrears for the periods from March 2008 to December 2008 are shown below:

To ask the Scottish Executive how many prosecutions brought under the Misuse of Drugs Act 1971 were dealt with by a direct measure in 2007-08, broken down by (a) police force area and (b) type of offence.

The following table shows the total number of charges under the Misuse of Drugs Act 1971 where the initial decision taken by the Procurator Fiscal was to deal with the offending behaviour with the offer of a fiscal fine in 2007-08.

The figures include only those direct measures which were affected by the Criminal Proceedings etc (Reform) (Scotland) Act 2007.

Of the eight charges under the heading Restriction of production and supply of controlled drugs, six involved the growing of a single cannabis plant, one involved the growing of three cannabis plants and one involved supply of a small quantity of cannabis resin to a friend, with no payment involved, in particular circumstances where the sheriff admonished the accused after she was prosecuted in court for failing to pay the fiscal fine.

To ask the Scottish Executive how many direct measures have been issued by procurators fiscal for vandalism in each month since August 2008, broken down by local authority area.

The following table shows the number of charges under Section 52(1) of the Criminal Law (Consolidation) (Scotland) Act 1995 (wilfully or recklessly destroy or damage property), where the initial decision taken by the Procurator Fiscal was to deal with the offending behaviour by means of a direct measure from September 2008 to February 2009.

The figures include only those direct measures that were affected by the provisions in the Criminal Proceedings etc (Reform) (Scotland) Act 2007.

The Crown Office and Procurator Fiscal Service (COPFS) database does not contain information to identify local authority areas and individual jurisdictions do not always match such areas. As a result, the information has been split by Procurator Fiscal offices.

To ask the Scottish Executive what the age profile was of those against whom (a) charges were brought and (b) prosecutions were made under the Misuse of Drugs Act 1971 in the Lothian and Borders police force area in each of the last three years.

A total of 4,898 of drugs charges reported were not proceeded with in court as a separate charge - but the accused was prosecuted for other charges (usually more appropriate drugs charges) in which the substance of the original offence was still prosecuted before the court.
