To ask the Scottish Executive whether any reduction in fishing effort in the white fish sector has arisen due to the cancellation, sale or transferring of licences outwith the recent decommissioning scheme in each of the last three years and, if so, what the si'e of such a reduction has been in each year.
Answer
It is certainly the case that a number of white fish licences have been used, and more are expected to be used, to licence incoming pelagic vessels. This will have the effect of reducing licensed white fish capacity and could lead to reductions in white fish fishing effort.It is extremely difficult to track the effects of these and other licence transactions: an exercise to do so would take some time and resources and could only be undertaken at likely disproportionate cost. However, work done previously to inform discussions in the joint industry/Departmental Working Group on fishing vessel licensing suggested that over 1998 and 1999, in licence transactions involving over 10 metre vessels, the average increase in effort of vessels new to the fleet (measured in GT days) was 34%. This was offset to some extent by a 10% drop in the fishing effort of donor licence vessels, following re-licensing.The effects on fishing mortality of such transactions will also depend, amongst other things, on the efficiency of the vessels concerned, including as a result of technological gains. Overall, it seems unlikely that licence transactions have resulted in a real reduction in fishing effort in the white fish sector.

To ask the Scottish Executive whether it interprets the principle of relative stability as a rule concerning access to waters and resources within the meaning of Article 19 of EU Council Regulation (EC) No. 2371/2002.
Answer
We understand relative stability to be a rule concerning access to resources within the meaning of Article 19 of EU Council Regulation (EC) No. 2371/2002. Specifically, relative stability underpins the rules concerning allocation of fishing opportunities, in as much as those opportunities shall be distributed in such a way as to assure each member state relative stability of fishing activities for each stock or fishery (Article 20 of EU Council Regulation (EC) No. 2371/2002).

To ask the Scottish Executive whether it has sought advice from Her Majesty's Government about whether the reallocation of fishing opportunities equivalent to deducted fishing opportunities, referred to in Article 23(4) of EU Council Regulation (EC) No 2371/2002, could result in the member state receiving the reallocation gaining fishing opportunities for stocks in International Council for the Exploration of the Sea (ICES) areas other than in ICES areas that had been deducted from the member state that had exceeded its fishing opportunities.
Answer
A reallocation of fishing opportunities between member states allowed for by the provisions of Article 23 Paragraph 4 of EU Council Regulation (EC) 2371/2002 can only be decided once the Commission has considered the likely impact of the reallocation on the interests of the member states involved and on the conservation of resources. Further, any decision must be taken by the Commission in accordance with the procedures laid down in Article 4 and Article 7 of Decision (EC) 468/1999. This makes it unlikely that such an eventuality could occur except in the most exceptional of circumstances.

Answer
I attended the Agriculture and Fisheries Council meeting on 27 January 2003, but not on 28 January, when I had to be in Scotland and London on fisheries business. Up to four Scottish Executive officials were in support, covering both days of the Council.

To ask the Scottish Executive from which budgets the #50 million fisheries aid package was taken and whether it will give a breakdown of this package.
Answer
The costs of this one-off, unplanned spending in 2003-04 will be met within the usual flexibilities available to the Executive in managing its overall resources. It will comprise a combination of carry forward of 2002-03 underspending and 2003-04 estimating, windfall savings in a range of demand determined spending. It is not possible to say at this stage what combination of 2002-03 and 2003-04 savings will deliver the resources required.

Answer
The rules concerning access to waters and resources are those rules described in Chapter IV (Rules on access to Water and Resources) of EU Council Regulation (EC) No. 2371/2002.These are subject to a fuller interpretation by reference to multiple decisions of the European Court of Justice and to the multifarious provisions of superior legislation, including but not restricted to Treaties of the European Union.

To ask the Scottish Executive whether the deductions from future fishing opportunities outlined in paragraph 1 of Article 23(4) of EU Council Regulation (EC) No. 2371/2002 would be for one year only or for an indefinite period.
Answer
Article 23(4) allows for a deduction from future fishing opportunities equivalent to the sum total of prior over-fishing, measured in tonnage. In most cases, it is to be expected that the full tonnage to be deducted will be deducted from opportunities allocated in the first calendar year following establishment of an occurrence of over-fishing.
