To ask the Scottish Executive whether the Lord Advocate and First Minister were consulted prior to the Cabinet Secretary for Justice visiting convicted murderer Abdelbaset Ali Mohmed Al Megrahi in HMP Greenock on 5 August 2009 and what was the nature of any advice or opinion

I explained in the answer to question S3W-24638 on 9 June 2009 the process that I intended to follow in considering the application for transfer of Mr Al Megrahi under the prisoner transfer agreement. It was not necessary for me to consult the Lord Advocate or First Minister.

To ask the Scottish Executive how many people in (a) Inverclyde and (b) Scotland have been refused a new central heating system under the energy assistance package since 22 May 2008.
Answer
The information requested is not available. The Energy Assistance Package was launched on 6 April 2009 and full monitoring information will only become available through time as applicants move through the stages. The Package presents a holistic approach to tackling fuel poverty by providing a range of people with a range of services at each stage including: income maximisation, energy efficiency advice and social tariff checks at stages 1 & 2, standard insulation measures at stage 3, and enhanced measures to improve the energy efficiency of the home at stage 4 including in some instances, new central heating systems. Information on the numbers receiving assistance at each stage of the package, including those who have received heating systems, will be published monthly on the Energy Saving Trust webpage once this becomes available.

To ask the Scottish Executive how many people refused a new central heating system under stage four of the energy assistance package would now be eligible under the revised guidance, broken down by local authority area.
Answer
The information requested is not available. No record has been kept, however numbers are expected to be small as Energy Saving Scotland advisers were aware that the guidance on assessing broken system was being prepared, and informed clients accordingly. All centres took action to identify such clients. One centre instructed clients to ring back at a later date and the other centres kept a list of those likely to be affected and subsequently contacted callers to encourage them to re-apply.

To ask the Scottish Executive how many applicants have been refused a new central heating system under the central heating programme on the basis that they have already received assistance within a 10-year period, broken down by local authority.
Answer
We would not expect anyone to be refused assistance under this part of the regulation for some time to come, as this rule only applies to those who have received assistance under Stage 4 of the energy assistance package in the past 10 years and the new package is in its infancy.

To ask the Scottish Executive when it introduced a rule excluding people from receiving help from stage four of the energy assistance package more than once in a 10-year period.
Answer
Clause 4 (5) of the Home Energy Assistance Scheme (Scotland) 2009 Regulations states No grant may be made in respect of any dwelling for which a grant under these regulations has been made within the previous 10 years. These regulations were laid before the Scottish Parliament on 13 February 2009 and came into force on 6 April 2009.
