To ask the Scottish Executive what the current supply of sheltered housing is in each local authority area, broken down by tenure type.

Information on the provisionof sheltered housing is available in tables 20 and 22 of the statistical bulletinQuarterly housing trends in Scotland: Quarter ending 31 March 2005. Table 20 gives information forMarch 2004 for all social housing including housing associations. To ask the Scottish Executive what funding it provided to Planning Aid for Scotland in the most recent year for which figures are available and what information it has on how this funding compares to that provided by government sources in England and Wales.

In financial year 2005-06, the Scottish Executive provided funding of £161,711. This is being increased so that in the current financial year, they will receive up to £225,283.

In 2005-06 the thenOffice of the Deputy Prime Minister provided funding worth £1.5 million for PlanningAid in England whilst the Welsh Assembly Government provided funding of £100,000to Planning Aid Wales over the same period.

To ask the Scottish Executive when sections 39 to 42 of the Charities and Trustees Investment (Scotland) Act 2005 will come into force.

Sections 39 to 42 of the Charitiesand Trustee Investment (Scotland) Act 2005, which have been commenced only for thepurpose of making regulations, establish a new regime for the reorganisation ofcharities, enabling charities to seek approval for reorganisation from the Officeof the Scottish Charity Regulator (OSCR), rather than having to apply to court.These provisions replace the old reorganisation provisions for most charities containedin the Law Reform (Miscellaneous Provisions)(Scotland) Act 1990, and for charitieswhich are also educational endowments under the Education (Scotland) Act1980. As the new provisions allow charities to apply to OSCR to reorganise as opposedto the court, the new regime will be both cheaper and quicker for charities.

We are currently developing regulationsunder sections 39, which make provision about the form and manner of applicationsto OSCR, and intend to consult on the new regulations later this year. We intendto commence the provisions and bring these regulations into force early next year.

To ask the Scottish Executive what the reasons are for some sections of the Charities and Trustees Investment (Scotland) Act 2005 not having come into force, broken down by section.

As with other acts of the Scottish Parliament, implementation of the Charities and Trustees Investment (Scotland) Act2005 has been a phased process. While most sections of the act have come into force,the following sections remain to be commenced:

(i) sections 39 to 42 which relateto the reorganisation of charities,

(ii) sections 49 to 64 of theact which relate to Scottish Charitable Incorporated Organisations,

(iii) sections 84 to 92 whichrelate to public benevolent collections,

(iv) section 96 (power of a charityto participate in certain financial schemes) and

(v) schedule 4 paragraphs 5(b)and (c), and 11.

The sections detailed in (i)to (iii) and consequentially the amendments in (v), above, will be commenced withthe introduction of secondary legislation, which is necessary to set out the detailof how these provisions will operate. We will be drafting and consulting on thesesecondary regulations, after which the relevant sections of the act will come intoforce.

Section 96 will be commencedfollowing the enactment of the UK Charities Bill, currently in Committee Stage inthe House of Commons, which will allow Scottish charities to participate in CommonInvestment Funds.

To ask the Scottish Executive how many people under 16 have had a known illegal drug problem, broken down by (a) age range and (b) NHS board area, in each year since 1999.

Information on the number ofyoung people who have a drug problem by age and NHS board area is not held centrally.Relevant information has been drawn from a number of sources.

The Scottish Drug Misuse Database(SDMD) collects information from people at the point of their coming into contactwith drug treatment services. Table 1 shows the number of new clients agedless than 16 years, who accessed drug treatment and rehabilitation services in theyears 1999-2000 to 2004-05, by NHS board area.

The Scottish Schools AdolescentLifestyle and Substance Use Survey provides information about monitoring substanceuse among young people in Scotland. Table two showsdata from the 2002 survey showing the percentage of 13 and 15 year olds who saidthey had used an illegal drug at least once in the previous month. Cannabis wasthe most commonly reported drug.

Table 3 shows the number of children under 16, dischargedfrom general acute Scottish hospitals with a drugs misuse diagnosis, from 1999-2000to 2004-05, by NHS board area.

Information on discharges frompsychiatric hospitals for children under 16 with drugs misuse-related diagnosisshows that: in 1999-2000 there were two children; in 2000-01 there were six children,and in 2001-02 there was one child.

1. New individual: anyperson who is attending for (a) the first time ever or (b) it has been at leastsix months since the last attendance.

2. All figures in this tableexclude penal establishment inmates and returns from needle exchanges

3. Individuals are includedonce within each health board area area. Therefore the local area data shouldnot be aggregated to produce a Scotland total.

4. Excludes mental illness hospitals,psychiatric units and maternity hospitals, and includes Scottish residentsonly.

5. Excludes transfer cases.

6. Information is onindividual patients, within a health board, within a year. The same patientwill be counted separately for each health board, so the sum of health boardnumbers may not equal the Scotland total. Similarly, if one patient is admitted in twodifferent years, they will be counted separately in each year.

7. Age at admission.

8. Figures in the tablerelate only to those individuals who are treated as inpatients in an acutehospital.

9. Discharges where drugsmisuse is recorded as either primary or secondary reasons for admission tohospital. Diagnostic information is defined by using the World HealthOrganisation's International Classification of Diseases 10th Revision (ICD10):F11, F12, F13, F14, F15, F16, F18, F19.

10. Caution is necessarywhen interpreting these figures. The recording of drugs misuse may vary fromhospital to hospital. Where drugs misuse is suspected but unconfirmed it maynot be recorded by the hospital.

To ask the Scottish Executive how many people aged between 8 and 16 were arrested by police officers and subsequently charged with an offence in each year since 1999, broken down by police force.
