To ask the Scottish Executive what boundaries are implied by the use of the word 'Scotland' in Section 29(2)(a) of the Scotland Act 1998 and whether it will provide details relating to these boundaries to the Scottish Parliament Information Centre.
Answer
For the purposes of the Scotland Act 1998, "Scotland" bears its ordinary meaning which derives from a variety of sources, some statutory, some based in common law and some based on generally accepted historical fact. Section 126(1) of the 1998 Act expressly defines "Scotland" as including so much of the internal waters and territorial sea of the United Kingdom as are adjacent to Scotland. Section 126(2) enables the boundary to be determined by subordinate legislation between waters which are or are not to be treated for the purposes of the 1998 Act as internal waters or territorial sea of the United kingdom adjacent to Scotland. The Scottish Adjacent Waters Boundaries Order 1999 (S.I. 1999/1126) specifies the boundary.

To ask the Presiding Officer whether, in the light of the report on the Holyrood Project which indicated that the construction only cost of the new Parliament Building was #2,696 per square metre of floor space, he will state how this compares with other major public works projects in Scotland in recent years.
Answer
The Scottish Parliament Corporate Body is not responsible for, and holds no information about the construction costs of other public work projects in Scotland, and because of the unique nature of the Parliament building, it would be inadvisable to make comparisons with other recently constructed Scottish public buildings.

To ask the Presiding Officer whether the design team for the Holyrood Project has been appointed under standard RIBA/RIAS conditions of engagement and, if so, at 10 June 1999 what fee payment stage had been reached in respect of the design of the members' building and the assembly building.
Answer
Each member of the Design Team has been appointed under the appropriate 'terms of appointment' issued by the professional body relevant to their individual discipline. The standard terms have been amended to take into account the particular nature of the project and the specific requirements of the Client. As at 10 June the Design Team were progressing into Stage E "Detail Design" for the building as a whole.

Answer
To date 'works package' contracts totalling just under £2.5 million have been awarded in respect of the Holyrood Project. No provisional sums have been included in those contracts.

To ask the Scottish Executive what progress is being made with the establishment of a comprehensive clinical audit system within each Health Board in Central Scotland and what priority has been given to the establishment of such a system in the plans for creating a more client-focussed service.
Answer
The 3 Health Boards and 6 Trusts serving Central Scotland (Ayrshire and Arran, Forth Valley and Lanarkshire) are refining their established clinical audit systems to reflect the new Trust configurations and their strategies for clinical effectiveness and patient/client focussed care. This is a high priority for all General Managers and Chief Executives in the NHS in Scotland and is signalled clearly in Health Improvement Programmes (HIPs), copies of which can be obtained from health Board Headquarters.

To ask the Presiding Officer whether any of the contracts awarded for the Holyrood Project impose obligations upon the Scottish Parliamentary Corporate Body to pay compensation for loss of work and breach of faith, and what advice did the SPCB take in relation to any court action in relation to loss of work or breach of faith being successful, in the event of the project being abandoned.
Answer
The contract conditions, which are standard to the construction industry, do not impose specific obligations to pay compensation for loss of work or breach of faith. Professional appointments and other contractors could however raise court actions for breach of contract which might include claims for damages related to loss of work and any other consequential losses. Legal advice was taken on the potential for such claims and related architectural and construction industry practices.

To ask the Presiding Officer what is the total value of provisional sums, contingencies and daywork allowances provided for within the contracts awarded for the Holyrood project.
Answer
A figure for contingency, which includes daywork allowance, is built into the total building cost estimate of £109 million and is commercially confidential. Individual works packages are each allocated a budget to cover all of the costs associated with the package, including provisional sums. These cannot be separately identified until 'invitations to tender' are issued for each works package.
