To ask the Scottish Executive how many requests for information it has received under the Code of Practice on Access to Scottish Executive Information.
Answer
Details of the number of requests received under the Code of Practice on Access to Scottish Executive Information during the period 1 July to 31 December 1999 were provided in my answer to question S1W-5908. I have today placed in the Parliament's Reference Centre a monitoring report on the operation of the code for the calendar year 2000. This report will also be placed on the Scottish Executive website.

To ask the Scottish Executive whether it has any plans to introduce a Tenement Law Bill and, if so, when.
Answer
The Scottish Law Commission published its Report on the Law of the Tenement (Scot Law Com No 162) in 1998. Following the publication of the subsequent Report on Real Burdens (Scot Law Com No 181) in October 2000, the Executive asked the Commission to update its recommendations on the law of the tenement to take account of its subsequent work on real burdens and title conditions. This is because the management of tenements is governed by rules and conditions set out as rights and real burdens in the relevant title deeds. The modernisation and simplification of the law on real burdens will rationalise the application and enforcement of burdens on all property, including tenements. Reforming the law relating to real burdens and title conditions first will mean that reform of the law of the tenement should be more straightforward. A Tenement (Scotland) Bill will therefore be introduced after enactment of the Title Conditions (Scotland) Bill when an opportunity arises in the legislative programme.

To ask the Scottish Executive what steps are being taken to address any problems of stress and low staff morale at the Scottish Qualifications Authority.
Answer
SQA's statement of how it intends to implement the recommendations of the Deloitte and Touche report (available from the Parliament's Reference Centre, bib. no. 9778) sets out a number of actions which are intended to address the problem of low morale. These include a review of working practices and procedures, organisational restructuring and the deployment and recruitment of additional staff.

To ask the Scottish Executive what its definition of "successful balanced communities" is as referred to in paragraph 2 of the Policy Memorandum to the Housing (Scotland) Bill.

In that particular context, neighbourhoods with a mix of good-quality affordable housing options, in which local people want to live, work and spend their leisure time.

To ask the Scottish Executive what the implications of Article 6 of the European Convention on Human Rights are for rating valuation appeals.
Answer
The Executive has considered the compatibility of the current arrangements in respect of valuation appeals as presently contained in the Valuation Appeal Committee (Procedures in Appeals under the Valuation Acts) (Scotland) Regulations 1995, and the Valuation Appeal Panels and Committees (Scotland) Regulations 1996, and is satisfied that they are compliant with the European Convention on Human Rights.

To ask the Scottish Executive, further to the answer to question S1W-12907 by Mr Jim Wallace on 13 February 2001, how many mortgage repossession orders were made in each court district in 2000 where the order was served on an owner who had purchased the property under the Right to Buy scheme, broken down in respect of domestic properties formerly owned by (i) local authorities, (ii) Scottish Homes and (iii) housing associations.

The information requested is not available. Data is collected with respect to the number of repossession orders granted by the courts. Specific information is not available in respect of the number of repossession orders where the order was served on an owner who had purchased the property under the Right to Buy Scheme.
