An automatic presumption in favour of pre-recording the evidence of complainers is a key feature of the Sexual Offences Court that the Victims, Witnesses and Justice Reform (Scotland) Bill seeks to establish, which is subject to scrutiny and agreement by Parliament.

In the meantime, existing courts already have the power to direct that the evidence of vulnerable witnesses be pre-recorded, and evidence by commissioner hearings are regularly used to pre-record evidence of complainers in serious sexual offences.

The Vulnerable Witnesses (Criminal Evidence) (Scotland) Act 2019 (“the Act”) makes it easier for child and vulnerable witnesses in the most serious cases to pre-record their evidence. The phased implementation plan for the Act builds in periods of evaluation to ensure that the roll out of its provisions is undertaken in a managed and effective way.

To date the Act has been commenced in relation to child complainers and witnesses giving evidence in the High Court in relevant cases. An evaluation of the operation of the Act in those cases has been conducted and a report of that evaluation is being finalised.

The Scottish Government established a cross-sector implementation group to monitor roll out of the Act. Once the evaluation report has been considered by the group it will be published on the Scottish Government's website with an aim to publish before the end of the year.

These recommendations are for the judiciary to progress and the terms of recommendation four of Lady Dorrian’s Review, Improving the Management of Sexual Offence Cases, were clear that these were matters that should be considered by the Jury Manual Committee. The Judicial Institute for Scotland has advised that the Jury Manual Committee is comprised of a number of experienced senators and sheriffs. It is clerked by secretariat staff of the Judicial Institute. The Jury Manual is publicly available and is kept under constant review. The Committee meets quarterly to agree revisions to the content of the Manual. It was most recently updated on 15 August 2023, when an important new chapter on rape myths and misconceptions was added. Detailed perusal of the Manual will disclose how the authors have dealt with Lady Dorrian’s recommendations. Further changes will be published on a regular basis.

As stated in the Scottish Policy Prospectus, I am committed to reform crofting law by 2026, subject to agreement by parliament, to support the future of crofting. The Programme for Government 2023-24 commits the Scottish Government to developing and consulting on proposals to reform crofting law. That is a key and necessary part of the process to develop and introduce a bill. We remain committed to doing so in this Parliamentary term.

Let me assure you that this scheme is a priority for us. It is a key recommendation in STPR2, it is included in the Programme for Government 2023 to 2024 as well as the First Minister’s Policy Prospectus, highlighting our commitment to a solution to the challenges at the Rest and Be Thankful. Also, at the travelling cabinet meeting in Inveraray on 2 nd October this year, the First Minister gave a firm commitment to the preferred route option for the A83 at the Rest and Be Thankful and the funding needed to deliver it.

The next step for the project, which is the detailed design and assessment of the preferred debris flow shelter option announced in June, is progressing at pace. This step should conclude by the end of 2024 with the publication of draft Orders for comment. Progress thereafter will depend on the level and nature of any representations, including objections, to the published draft Orders.

As with all our infrastructure projects, construction of the long term solution can only commence if it is approved under the relevant statutory authorisation process and thereafter a timetable for construction can be determined.

At the same time, improvements to the existing Old Military Road (OMR) through the Glen Croe corridor are being made to make it a more resilient diversion route until the long term solution is in place. A detailed programme for the proposed improvements is being developed, but it is expected that these works will be carried out on a phased basis starting later this year.

Scottish Government grant making to the third sector, including credit unions, is allocated across portfolios to improve a wide range of outcomes. Some Scottish Government funding will also be issued through independent grant makers or intermediary organisations. This information is not centrally collated.

Streetlighting is the responsibility of local councils. We are not aware of any particular supply chain issues but we would be happy to consider this if the member can provide more information.

Learning and evaluation continue to be a key aspect of our approach to employability services in Scotland.

The Implementation evaluation of the development and early delivery of No One Left Behind and the Young Person’s Guarantee was commissioned by the Scottish Government and published on 10 August 2023.

We will consider the recommendations from the evaluation alongside the outputs from our recent national stakeholder discussion events and actions will be reviewed to identify how we can improve.

The decision on whether to appoint a local women’s champion or advocate sits with local authority areas. As such, the government does not hold a list of champions or advocates. The government is, however, fully committed to working with local authority areas to ensure that we take, when appropriate, a gendered response to substance use. That is why we have committed more than £5.5 million to establish two houses, run by Aberlour, which are designed to support women and their children through recovery. In addition, we are providing more than £6 million to establish a training and social enterprise based residential rehabilitation programme at River Garden Auchincruive which will have a separate unit to support women through recovery.
