Criminal Justice Committee [Draft]
Meeting date: 30 April 2025

Good morning. Thank you for coming and for such a detailed and informative report. It has an awful lot in it. I am just processing it all. Ben Macpherson’s point and your response were really interesting. Any more information on that front would be good.
A whole bureaucratic morass seems to have opened up since Brexit, but steps are being taken to improve the situation and make the best of what we have. I get that there is no such thing as a typical case, but do you have any indication or data on how much longer it has been taking to process a case since Brexit?

Complete the picture.

That is fine—again, I suppose that people who deal with those matters daily will have answers to that. Do you see the situation vastly improving? You have explained that things have been brought in to help us to work together as much as possible, but do you think that there will be much change over the next decade, say?
Delegated Powers and Law Reform Committee
Meeting date: 29 April 2025

Good morning. I was going to ask you the same question that I asked of David Bartos about responses to the call for views, in which some arguments were made about tenants and landlords being given the same amount of time, and about whether oral notice of the ending of a lease could be given by a tenant who has a lease of less than one year. However, I am not going to ask you about that, because, from what you have said, I think that I have gathered what the answer is.
I am mindful that, in relation to one of the rules—I cannot remember which—David Bartos said that there was no change. I had said something like, “But does that not happen just now? Does the landlord not have to give written notice?”, and he said yes. In that sense, therefore, on that particular aspect, nothing changes. Am I correct in that, or am I getting confused?

Would that be more preferable for the landlord or the tenant? I am trying to get an idea of what the power balance would be.

So, it could be disputed.

I was going to ask about that third issue, of which there is criticism in some of the responses to the call for views.

That is fine. I just wondered whether you wanted to comment.

Nothing changes in that regard, then.

I will follow on from my colleagues’ questions and pick up a couple of the arguments that were made in response to the committee’s call for views. Some arguments were made that the rules on giving notice should be the same for both tenants and landlords, which differs from the approach that is taken in the bill. Rachel Rayner, what is your opinion on that?
