Children (Care and Justice) (Scotland) Bill: Stage 1

Meeting date: 3 May 2023

Sue Webber

Let us move on.

Children (Care and Justice) (Scotland) Bill: Stage 1

Meeting date: 3 May 2023

Sue Webber

The Scottish Sentencing Council has guidelines for sentencing our young people. They apply to a young person who is under the age of 25 at the time of entering a guilty plea or when they are found guilty of an offence. There have been some cases recently. Were those guidelines considered when the bill was drafted? If so, why does the bill not go further to provide consistency with regard to the age of a young person in the criminal justice system?

It will be interesting to see how that develops.

We move to questions from Bill Kidd.

Thank you for being so good with your time, minister. We move to questions from the committee. I hope, in the interests of time, that one person will be able to respond to each question.

I did not get a sense of how you would be evaluating MRCs, but, perhaps when you respond to Mr Doris’s supplementary, we might be able to pick out a little more on evaluating MRCs.

Thank you very much.

Deputy Convener

Meeting date: 26 April 2023

Sue Webber

Due to the changes in the committee’s membership, our next task is to choose our deputy convener. The Parliament has agreed that only members of the Scottish National Party are eligible for nomination as deputy convener of the committee, and I understand that Ben Macpherson is the Scottish National Party’s nominee.

Ben Macpherson was chosen as deputy convener.

I did not think so.

We have had discussions on that issue. Under the bill, it will be possible for a child convicted of a serious crime to be placed in secure accommodation with young people who will be there on welfare grounds and who are therefore particularly vulnerable. Is that a cause for concern? What steps might need to be taken to ensure that the rights and best interests of all children in secure accommodation are taken into account?

Does Ben Farrugia or Stephen Bermingham want to comment on that, or has Jackie Irvine covered most of the ground?
