At the moment, there is support from Scottish Women’s Aid and Victim Support Scotland, and there are people in the court who help victims along the way. If we should be directing funds towards that to make sure that we deal with victims in a trauma-informed way, that is something that we should look at. When we took evidence, one of the key points that we heard was that victims felt as if they were completely ignored and that they were a witness in their own case. They felt that they did not have any involvement.
Amendment 104 would give victims the opportunity to talk for themselves in the court. It would allow the judge or sheriff to read out the statement, and the judge or sheriff would have the opportunity to shorten the statement. The amendment would give victims the ability to do something that the committee heard that they have not been allowed to do.

My amendment 105 would provide for a much-needed review to be conducted into the statutory entitlement of victims to receive information on fiscal fine penalties. Specifically, it would look at the information that is provided on whether a fiscal fine is accepted or rejected by an offender and the reason given by an alleged offender as to why the fiscal fine was accepted or rejected. Victims deserve to be told that information. The amendment is intended to be complementary to Liam Kerr’s amendment 53, which he will explain shortly. It will be for the Scottish ministers to prepare and publish the review within two years of the provision coming into force.
I am grateful that the Government has worked with me on my amendments. My additional amendments 105A to 105E make minor changes to ensure Scottish Government support. I also thank you, Presiding Officer, for allowing the submission of the late amendments.

On that point about searches, you said that staff cannae do a search even if they are using a wand. I can understand the issue if it is a physical search and somebody is put their hands on to somebody else. I am just thinking about how, if you go through airport security or something like that, sometimes someone of the opposite sex does the check and they are not actually touching you. Are you saying that you cannae do that in the prison?

I wondered how much training they get to carry out the policy. The impression that I got from the prison estate when we visited a prison and walked around was that it looked very calm and organised and—dare I say it?—peaceful. I did not see what you are seeing on a daily basis. How do they know what to do, and what training do they get for the MORS policy? If there is that amount of drug taking, at what level do you decide that somebody should go on to the MORS policy, and how much pressure does that put on staff? What would be the implications if there were a death in prison due to a drug overdose? Would the responsibility fall on the staff for not putting somebody on the MORS policy when maybe they should have been on it and being observed every 15 minutes?
