Agenda item 2 is consideration of an instrument that has been laid under the European Union (Withdrawal) Act 2018; we are looking at the instrument under the Scottish statutory instrument protocol. It has been laid under the affirmative procedure, as is required by the 2018 act, so we are considering only the categorisation that the Government has recommended. Our advisers indicate that the low categorisation could be appropriate.
