We move speedily on to agenda item 3. Members may recall that we considered the powers in the bill at our last meeting before the October recess and raised some questions. We have seen the responses from the Government.

On section 9, "Certificate for sequestration", as the Scottish Government has indicated in its response that it is intended that the scope of the power in section 5B(5)(e) as inserted by section 9 will relate only to formalities of process and advice and information requirements, and not to additional substantive conditions, do members agree that we consider that that power could be drawn more narrowly to reflect that limited scope?

On section 15, "Ancillary provision", do we agree to recommend that the power in section 15(1)(a), to make supplemental et cetera ancillary provisions that modify acts, should be subject to affirmative resolution procedure, whether or not such modifications are in the form of textual amendment of an act?
