Good afternoon. Welcome to this meeting of the Health and Community Care Committee.

The agenda is short this afternoon. We must deal first with an emergency affirmative instrument. The Deputy Minister for Health and Community Care, Mary Mulligan, is present to move the motion.

The instrument is the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 2002. The Subordinate Legislation Committee has nothing to report and no comments have been received from members. I ask the minister to speak to and move the motion.

The Deputy Minister for Health and Community Care (Mrs Mary Mulligan):

The instrument is an emergency order prohibiting the harvesting of king scallops from waters in the south Minch, in the Isle of Mull region off the west coast of Scotland, and has been triggered because levels of amnesic shellfish poison have been found above the action levels that were set by Europe. The instrument is a consumer safety measure, because scallops that contain high levels of toxin can cause illness in humans. I ask the Parliament's Health and Community Care Committee to approve the order.

I move,

That the Health and Community Care Committee recommends that the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 2002 (SSI 2002/49) be approved.

Food and Animal Feedingstuffs (Products of Animal Origin from China) (Control) (Scotland) Regulations 2002 (SSI 2002/36)

The first negative instrument is the Food and Animal Feedingstuffs (Products of Animal Origin from China) (Control) (Scotland) Regulations 2002 (SSI 2002/36). No comments have been received from members. The Subordinate Legislation Committee has contacted the Executive on a number of points. No motion to annul has been lodged, so the recommendation is that the committee does not wish to make any recommendation on the instrument. Are we agreed?

The final negative instrument is the Notification of Marketing of Food for Particular Nutritional Uses (Scotland) Regulations 2002. No comments have been received from members, the Subordinate Legislation Committee has made no comments and no motion to annul has been lodged, so the recommendation is that the committee does not wish to make any recommendation on the instrument. Are we agreed?
