Scottish Government Responses

The Convener (Jamie Stone):

I welcome everyone to the 12th meeting of the Subordinate Legislation Committee in 2008. I hope that everyone in the room today has had a refreshing break. We have received apologies from Jackson Carlaw. I ask members to turn off any mobile telephones.

I refer the committee to the summary of recommendations, to which I shall refer as we proceed through the meeting.

After our meeting on 25 March, we wrote to the Scottish Government about four Scottish statutory instruments, and members have now seen the responses.

Bankruptcy and Diligence etc (Scotland) Act 2007 (Commencement No 3, Savings and Transitionals) Order 2008
(SSI 2008/115)

Are members content to draw the order to the attention of the lead committee and Parliament on the grounds set out in the summary of recommendations?

Members indicated agreement.

Police (Special Constables) (Scotland) Regulations 2008 (SSI 2008/117)

The Convener:

Do members think that the Government's response to our questions (a) and (b) is only partially satisfactory and, if so, should we report that to the lead committee and Parliament accordingly? Also, are members satisfied with the Government's response to question (c) and happy to report it to the lead committee and the Parliament?

Members indicated agreement.

Are members also content to report to the lead committee and Parliament on questions (d) to (h) inclusive, as set out in our summary of recommendations?

Members indicated agreement.

Act of Sederunt (Sheriff Court Rules Amendment) (Diligence) 2008
(SSI 2008/121)

The Convener:

Are members content to draw the act of sederunt to the attention of the Parliament on the ground that the reference in paragraph 6(2) to rule 5.6 rather than rule 5.5 is an error, which the Lord President's office has acknowledged and has undertaken to amend at the next opportunity? They have held their hands up and are going to put it right.

Members indicated agreement.

Act of Sederunt (Rules of the Court of Session Amendment No 4) (Miscellaneous) 2008 (SSI 2008/123)

Are members content to draw the act of sederunt to the attention of the Parliament on the grounds set out in the summary of recommendations?

Members indicated agreement.
