Scottish Government Response

I welcome everyone to the 20th meeting in 2008 of the Subordinate Legislation Committee. We have received apologies from Jackson Carlaw. I remind everyone to turn off their mobile phones and BlackBerrys. I particularly welcome Shelagh McKinlay, who has replaced Gillian Baxendine. Welcome to our happy band.

Last week, we wrote to the Scottish Government about one instrument and we have received the response.

Feed (Hygiene and Enforcement) (Scotland) Amendment Regulations 2008 (SSI 2008/201)

Are members content with the Food Standards Agency's explanation of how the requirements of section 84(1) of the Agriculture Act 1970 were fulfilled? Are we also content to note that the Scottish Government has failed to follow the normal drafting practice of narrating the satisfaction of preconditions in the preamble to the regulations, and to draw the regulations to the attention of the lead committee and Parliament on that basis?
