Disabled Persons' Parking Places (Scotland) Bill: Stage 1
The minute has come. I welcome members to the 23rd meeting in 2008 of the Subordinate Legislation Committee. We have apologies from Jackie Baillie and Ian McKee. As usual, members should check that they have turned off their mobiles, BlackBerrys and whatnot.
Members should note that the bill is a member's bill and that the member in charge is Jackie Baillie, who is also a member of this committee. Although Jackie is not here today, I should say that under rule 9.13A.2 of standing orders, she will not be able to participate in any consideration of the bill by this committee. Jackie has been made aware of this; indeed, she knew it already.
On section 5, "Disabled street parking orders: requests by qualifying persons", are we satisfied that the delegated powers in subsection (6) are acceptable in principle, and that they are subject to negative procedure?
Members indicated agreement.
Are we also content to draw to the attention of the lead committee and Parliament the power conferred on local authorities in section 5(6)(b), on the basis set out in the summary of recommendations, to which I should have drawn members' attention earlier?
Members indicated agreement.
On section 11, "Annual reports by local authorities", are members satisfied that the delegated power in subsection (3) is acceptable in principle, and that it is subject to affirmative procedure?
On section 12, "Annual report by the Scottish ministers", are members satisfied that the delegated power in subsection (3) is acceptable in principle, and that it is subject to affirmative procedure? Are we content with those points?
Members indicated agreement.
That concludes our consideration of the bill at stage 1. However, the bill is of some interest to many people beyond this committee.
