Scottish Mental Welfare Commission submission of 6 October 2021

PE1857/D: Regulate the role of curator ad litem

Thank you for your letter of 8 September 2021 seeking views on the above petition with specific reference to the question of regulation of the role of curator ad litem.

The Mental Welfare Commission’s understanding is that curators ad litem (usually social workers and solicitors) are bound by the regulations of their respective professions. It is therefore the case that if there are any concerns or complaints in relation to their practice, the relevant professional regulatory body is responsible.
