Social Justice and Social Security Committee
At its meeting on 30 September 2021 (6th meeting, 2021)i, the Social Justice and Social Security Committee considered the Social Security (Advocacy Service Standards) (Scotland) Amendment Regulations 2021.
The instrument was laid on 30 August 2021 and is subject to the affirmative procedure. This means it is for the Committee to recommend to the Parliament whether the draft regulations be approved.
These regulations amend the Social Security (Advocacy Service Standards) (Scotland) Regulations 2021 to set revised Advocacy Service Standards, which no longer reference instructed advocacy. This will enable advocacy providers to offer non-instructed advocacy services to Social Security clients if required.
In advance of its meeting on 30 September 2021, the Committee requested a copy of the draft revised Advocacy Service Standards to inform its scrutiny of the regulations. The Minister shared the draft with the Committee in confidence.
The Delegated Powers and Law Reform Committee considered the instrument at its meeting on 7 September 2021, and made no recommendations in relation to this instrument.

That the Social Justice and Social Security Committee recommends that the Social Security (Advocacy Service Standards) (Scotland) Amendment Regulations 2021 be approved.
