Report on the Registered Social Landlords (Repayment Charges) (Scotland) Regulations 2018

Introduction

  1. The Local Government and Communities Committee reports to the Parliament as follows—

  1. The Registered Social Landlords (Repayment Charges) (Scotland) Regulations 2018 [draft] was laid before the Parliament on 14 June 2018 and referred to the Local Government and Communities Committee for consideration.

  1. This instrument is subject to affirmative procedure (Rule 10.6) and it is for this Committee to recommend to the Parliament whether the Regulations should be approved.

  1. These Regulations enable a registered social landlord (“RSL”) to make a repayment charge in favour of itself to recover a sum which the RSL has paid on behalf of an owner when enforcing a scheme decision under the Tenements (Scotland) Act 2004.


Consideration by Committees

  1. The Delegated Powers and Law Reform Committee considered this instrument at its meeting on 19 June 2018 and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.

  1. At its meeting on 5 September 2018, the Local Government and Communities Committee took evidence from—

    Kevin Stewart, Minister for Local Government, Housing and Planning, Scottish Government.

  1. During the evidence session, the Minister stated that these Regulations would give RSLs flexibility in relation to the payment of common works in tenement buildings in which they have a share and the ability to use the missing share power if they wished to do so.

  1. Following the evidence session, Kevin Stewart moved motion S5M-12905—

    That the Local Government and Communities Committee recommends that the Registered Social Landlords (Repayment Charges) (Scotland) Regulations 2018 [draft] be approved.

    The motion was agreed to without division.
