The Culture, Tourism, Europe and External Affairs Committee reports to the Parliament as follows-

The UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020 were laid before the Parliament on 16 October 2020 and referred to the Culture, Tourism, Europe and External Affairs Committee for consideration.

On 17 March 2020 UEFA announced that the 2020 European Championship would be delayed until 2021. The change in dates meant that changes were required to both primary and secondary legislation in Scotland. The purpose of these regulations is to help ensure successful delivery of the Union of European Football Associations (UEFA) European Football Championship (the Championship) which will be hosted, in part, in Glasgow in summer 2021. The regulations do this by enabling the commitments required by UEFA in relation to protection of commercial rights for event sponsors during the period of the event to be met.

The policy note states that the regulations set out what trading consists of and prescribe the circumstances for which exceptions to the trading and advertising offences will apply. They also include maps of the three event zones where the restrictions will apply and when each event zone will be in operation.

The Committee considered and approved a previous iteration of this instrument on 12 March 2020. The Instrument was not signed into law by the Cabinet Secretary for Economy, Fair Work and Culture following the postponement of the European Championships, in March 2020. Accordingly, the Committee was required to consider this affirmative instrument which, amongst other matters, takes account of the revised dates for the UEFA European Championships in 2021.

The Delegated Powers and Law Reform Committee considered this instrument at its meeting on 27 October 2020 and determined that it did not need to draw the attention of the Parliament to the instrument on any ground within its remit.

At its meeting on 26 November 2020, the Culture, Tourism, Europe and External Affairs Committee took evidence on the instrument from—

• Fiona Hyslop, Cabinet Secretary for Economy, Fair Work and Culture;

• Lucy Carmichael, Bill Team Leader, Scottish Government; and

• Ninian Christie, Solicitor, Scottish Government.

During the discussion on the instrument, Committee members questioned the Cabinet Secretary about the impact of the pandemic on the organisation of the tournament.

"That the Culture, Tourism, Europe and External Affairs Committee recommends that the UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020 [draft] be approved."

The motion was agreed to without division.
