Criminal Justice Committee
At its meeting on Wednesday 26 October 2022, the Criminal Justice Committee considered the Scottish Biometrics Commissioner Act 2020 (Code of Practice) (Appointed Day) (Scotland) Regulations 2022 [draft].
The instrument is subject to the affirmative procedure. It was laid before the Scottish Parliament on 7 September 2022.
The instrument is made in exercise of the powers conferred by section 13(1) of the Scottish Biometrics Commissioner Act 2020.
The purpose of the instrument is to specify the day appointed for the coming into effect of the code of practice ("the Code") prepared by the Scottish Biometrics Commissioner under section 7 of the Scottish Biometrics Commissioner Act 2020 (the 2020 Act), and approved by the Scottish Ministers under section 12(2)(a) of the 2020 Act.
A copy of the Code has been laid alongside the instrument.
The Delegated Powers and Law Reform Committee ("DPLR Committee") considered the instrument at its meeting on 20 September 2022.
The DPLR Committee raised no points on the instrument.
Motion S6M-05906 was lodged proposing that the Committee recommends approval of the instrument. At its meeting on Wednesday 26 October 2022 the Committee took oral evidence on the draft instrument from the Cabinet Secretary for Justice and Veterans, Keith Brown ("the Cabinet Secretary").
During the evidence session, the Cabinet Secretary outlined the purpose of the instrument to the Committee as set out previously.
There being no questions from Members, the Cabinet Secretary moved the motion in his name:
