We have legislated to strengthen victims’ rights and voices—from the introduction of the victims code for Scotland and the standards of service for victims and witnesses to the strengthening of the victim notification and victim statement schemes.
We might or might not want to exclude that individual, but how would we make that decision in law? I would look to the civil codes of France, Germany and Poland or any of the continental civil codes in which, in certain defined circumstances, forced provision can be avoided by a testator.

The published Crown Office and Procurator Fiscal Service Prosecution Code sets out the criteria for prosecutorial decisions and the range of options available to prosecutors dealing with reports of crime.
I had wanted to raise the question of whether there is another way of addressing lobbying, perhaps by tightening up the code of conduct, the ministerial code and the civil service code, but I have had the opportunity to raise those issues in answer to earlier questions.
The Code further requires that the skills, knowledge and experience will be described in a way that is readily understandable, is capable of assessment and reflects the requirements of the role.
