Relevant bodies will be held to account for compliance, through statutory inspection, with statutory requirements and standards which are set out in the legislation and Code of Practice specified in the instrument.
The Committee is content that consultation by the Electoral Commission on the code of practice for third party campaigners would be with the Parliament, rather than a designated committee.
Land-owning maintenance companies have to comply with the rules in the Code of Conduct and the property factor's duties as they are specifically defined as "property factors" in the 2011 Act (Section 2(1)(c)).
The following rule changes are proposed to Rule 9.21 Emergency Bills:
In Rule 9.21.6:
Delete the last sentence of Rule 9.21.6: "An Emergency Bill which has been amended at Stage 2 so as to insert or substantially alter provisions conferring powers to make subordinate legislation, or conferring powers on the Scottish Ministers to issue any directions, guidance or code of practice, is not required to be considered by the committee mentioned in Rule 6.11.2."
The Bill confers 7 powers to make subordinate legislation on the Scottish Ministers:
Section 8(1)(b) – Power to impose a fee for registering a litter
Section 8(2)(g) – power to specify additional registration information
Section 11(1)(c) – Power to specify changes in registration information that trigger a requirement to update the register
Section 15(1) – Provision for or in connection with the deletion from the register of old entries
Section 17(1) – power to authorise further access to the register information
