Paragraph 96(b) in our legal brief suggests that we ask the Scottish Government,“given that the power is to modify provisions in the Act, whether the affirmative procedure is a more suitable level of scrutiny for the exercise of this specific power”.That means that we are asking that an affirmative instrument be laid before Parliament on every occasion rather than just allow the Government to get on and get things done. On this small matter, I am quite happy to allow the Government to get on and get things done.
