Conclusion
A finding of a breach of the 2006 Act and the Code of Conduct is a serious matter. Acknowledging the efforts made by Jackson Carlaw MSP to act with propriety, the Committee is of the view that its agreement with the Commissioner on the finding of a breach is sanction enough.
This valuable work will help to inform the Scottish Biometrics Commissioner’s future statutory code of practice for the use of technologies in policing which collect biometric data.
Background
The Committee published a report on 14 November 2018 in which it committed to review the Code of Conduct with the aim of strengthening its rules on confidentiality of documents and the disclosure rules relating to MSP complaints.
The Commission remains focused on enforcing compliance with the Codes of Conduct and promoting the ethical standards framework to assist councillors and members of devolved public bodies to achieve the highest ethical standards.
Does the committee agree to take in private, at a future meeting, consideration of revisions to the guidance on the code of conduct for MSPs and consideration of its approach to petition PE1949, which calls for a review of the rules concerning dual mandate MSPs?
