(2) In section 5A (code of practice on deer management), in subsection (1), after “management” insert “and the circumstances in which it will intervene in the management or control of deer”. 30 (3) In section 5B (review of compliance with code of practice on deer management)— (a) in subsection (1), for “must, before the expiry of the period mentioned in subsection (4),” substitute “may, at any time,”, (b) after subsection (1), insert— “(1A) SNH must carry out a review under subsection (1)— 35 (a) if required to do so by the Scottish Ministers, 14 Natural Environment (Scotland) Bill Part 4—Deer management (b) within such period as it considers appropriate following a replacement code or revision (other than a minor revision) of the code coming into effect, and (c) otherwise, not less than once in each review period.”, 5 (c) for subsection (4), substitute— “(4) For the purposes of subsection (1A), “review period” means each period of 10 years beginning with the date on which the Scottish Ministers most recently laid a report before the Scottish Parliament under subsection (3).”.

However, the implications of that interpretation are so significant that we ask the Committee to: • Make a representation to the EHRC that it considers very carefully the correct interpretation of the judgment, including in the light of its responsibility to promote compliance with the European Convention on Human Rights, before drafting its new codes of practice; • Make a representation to the EHRC that when it consults on drafts of any new codes of practice, it ensures that trans organisations and people have an opportunity to respond fully in a meaningful way and that this engagement will be approached in good faith; • Make a representation to the EHRC that when it produces its new code of practice, it dedicates equal time to explaining how to include trans people in spaces, services and associations as it does to explaining how to exclude them; • Engage with the EHRC’s consultation on its draft new codes of practice; 21 • Urge the Scottish Government not to make premature statements about the implications of the judgment, but to wait until the EHRC’s drafting and consultation have taken place; • Whatever the ultimate interpretation of the judgment, continue to hold public bodies and others accountable for their treatment of trans people in a way that maximises their wellbeing and human rights, consistent with the UK reserved legislation.
