The Government therefore considers that the provisions of the Scottish Ministerial Code, together with the obligations applying to civil servants under the Civil Service Code, provide an appropriate framework regarding candour (Recommendation Paragraph 135).
What main factors should be considered in order to ensure that the code is robust enough? Following on from what Professor Wiles said, it is important that a code of practice is driven by clear principles.
It includes:
compulsory registration for property factors operating in Scotland
a Code of Conduct with minimum standards which property factors have to follow
a dispute resolution system - homeowners can bring cases to the First-tier Tribunal for Scotland (Housing and Property Chamber) if their property factor breaches the Code of Conduct.
The four integrity sub-dimensions are:
employment restrictions;
public officials' code of conduct;
lobbyist code of ethics;
self-regulation by lobbyist associations.
A flat owner or flat owners can complain to the First-tier Tribunal for Scotland (Housing and Property Chamber) ('the First-tier Tribunal') if the factor is not complying with the Code of Conduct or certain other parts of the 2011 Act.
These costs will be either the annual levy which PoBs will be required to contribute to, or as a result of actions in relation to implementing the code (such as moving to an MRO agreement, participating in arbitration or a result of financial penalties issued by the Scottish Pubs Code Adjudicator (SPCA)).
