This is important because beyond the employer and the police it transpires that it’s only the GTCS who can investigate teachers alleged to be involved with safeguarding issues / failures - (1) The SPSO under its own legislation is forbidden from investigating the conduct of teachers (2) The Scottish Government and Education Scotland is prevented through legislation from getting involved in individual cases. (3) The Health & Safety Executive (HSE) won’t intervene because it insists that Education Scotland should investigate health & safety failings referred to them.
