Strategic Lawsuits Against Public Participation

  • Submitted by: Stephen Kerr, Mid Scotland and Fife, Scottish Conservative and Unionist Party
  • Date lodged: Tuesday, 06 October 2026
  • Motion type: Members' Business Motion
  • Motion reference: S7M-01487
  • Current status: Achieved cross-party support

That the Parliament condemns the use of strategic lawsuits against public participation (SLAPPs) and abusive legal threats to silence survivors of sexual and domestic abuse, journalists, whistleblowers and campaigners, including those in the Mid Scotland and Fife region; notes with concern evidence submitted to the Scottish Government’s consultation, suggesting that survivors have been pressured to retract allegations and withdraw statements to the police; recognises that fear of unaffordable legal expenses can silence people before proceedings reach court; further recognises the Scottish Government’s acceptance of the need for reform; notes the calls for a clear timetable for anti-SLAPP legislation, which would provide for early dismissal of abusive proceedings and protection against prohibitive legal expenses, while safeguarding legitimate claims, and further notes calls for immediate action to improve access to legal advice and address intimidation through threats of litigation.
