Supporting the Independence of the Supreme Court

That the Parliament reaffirms its full support for the independence, impartiality and integrity of Scotland’s judiciary, including the Supreme Court; notes what it sees as the vital role of the courts in upholding the rule of law, protecting fundamental rights and maintaining public confidence in the justice system; considers that it is the duty of all MSPs under section 1(1)(d) of the Judiciary and Courts (Scotland) Act 2008 to uphold the continued independence of the judiciary; reaffirms its commitment to judicial independence, the rule of law and the integrity of the Scottish Parliament; commends the Supreme Court for what it sees as its continued commitment to justice, fairness, legal independence and upholding the rule of law, and urges all MSPs to defend the independence of the Supreme Court and challenge anyone who seeks to undermine or degrade it through the use of inflammatory comments or the spread of misinformation.
