To ask the Scottish Government whether it will ensure that developers prioritise full fibre broadband rollout and promote consumer choice by consulting more than one broadband provider, and whether such changes could be built into the Planning (Scotland) Bill by way of secondary legislation or guidance for local authorities.

The choice of broadband providers available to occupants of new build housing will be influenced by factors beyond the scope of the planning system to control. Whilst the Scottish Government is not considering such a requirement in the Planning (Scotland) Bill, where powers are available to us we have already taken action to facilitate improved investment in digital infrastructure. This includes setting out planning policy in relation to telecoms in both Scottish Planning policy (paragraphs 292-300) and in the National Planning Framework (chapter 5).

To ask the Scottish Government what consideration has been given to including provisions in the Planning (Scotland) Bill to ensure that new (a) housing developments are built with future-proofed broadband connections, and (b) home buyers have a choice in broadband networks when moving into a new housing development.

Through the Reaching 100% Programme, the Scottish Government is committed to ensuring that each and every premises in Scotland has access to superfast broadband. We would, however, expect new housing developments to be served commercially without the need for public funding and through effective partnership working between planning authorities, developers and telecoms companies, for example, Openreach routinely offers fibre to the premises (FTTP) – for free – on developments of at least 30 properties, with a tariff proposal for smaller developments.

Whilst the Scottish Government is not considering such a requirement in the Planning (Scotland) Bill, where powers are available to us we have already taken action to facilitate improved investment in digital infrastructure. This includes setting out planning policy in relation to telecoms in both Scottish Planning policy (paragraphs 292-300) and in the National Planning Framework (chapter 5).

From January 2017, amendments to the Building (Scotland) Regulations 2004 set a standard for in-building physical infrastructure for high-speed electronic communications networks. This enables easier installation of fibre at any time (on or after completion) and applies to new homes and other buildings.

Telecoms is, however, reserved to the UK Government and, as such, they have recently consulted on introducing new legislation to address issues with new build developments. The Scottish Government will look to ensure Scottish interests are reflected in the development of any legislation, and to understand the implications for any devolved areas.

To ask the Scottish Government how many businesses it expects will benefit from the extension of transitional relief for the hospitality sector, broken down by local authority.

The following table the estimated number of hospitality properties that are eligible for Transitional Relief in each financial year up until the next revaluation by Local Authority. The table should be interpreted as the maximum number of hospitality properties eligible for the relief in a given year. The Scottish Government does not currently hold property level data on those in receipt of Transitional Relief.

Adjustments are made to account for properties that are ineligible for Transitional Relief because they were already in receipt of 100% rates relief. Further adjustments are also made to partially account for State Aid limits on the amount of relief a businesses is eligible to receive, however, the full impact of State Aid limits cannot be modelled with the data available. Combined with factors such as ratepayer awareness of the relief means the estimates presented in the table should be treated as a maximum.

To ask the Scottish Government how many businesses in each local authority area will be exempt from business rates in 2019-20.

The Scottish Government does not make forecasts of the number of properties that will be exempt from non-domestic rates in future years. The table below presents the estimated number of properties exempt from non-domestic rates in 2018-19. Exempted properties include those receiving 100% rates relief, and properties with a zero rateable value. Non-domestic properties that are not listed on the Valuation Roll, such as agricultural processing facilities, are not included in the following table.

Updated information for 2019-20 will be available in autumn 2019.

The following table shows how much non-domestic rates relief has saved businesses cumulatively from 2009-10 until 2017-18, based on local authority audited income returns. Local authority breakdowns are not currently available for earlier years.

To ask the Scottish Government what estimate it has made of how much the cap on the increase in the rates poundage in Scotland will save businesses, broken down by local authority.

For 2018-19 we limited the inflationary increase in the non-domestic rates (NDR) poundage to the Consumer Price Index (CPI), rather than the Retail Price Index (RPI) as had previously been the case. In 2019-20 we have gone further by limiting the inflationary increase in the poundage to less than CPI (2.1% compared to 2.2%). The estimated overall saving to businesses in 2019-20 as result of this decision is £35.2 million, relative to the baseline where the Scottish Government would have uprated the poundage by RPI. The following table provides a breakdown by local authority of the estimated saving based on the latest NDR income reported by local authorities on their 2018-19 Mid-Year Estimate returns.
