To ask the Scottish Executive whether it supports further legislation to regulate property factors.
Answer
We are working with stakeholders to develop an industry-led voluntary accreditation scheme for property managers. We intend to monitor the effectiveness of the scheme once it is introduced and have made it clear to stakeholders that if unacceptable practices persist, then ministers will seek to use stronger powers to address the problems identified.

To ask the Scottish Executive whether it is considering any legislation to update the Tenements (Scotland) Act 2004.
Answer
The Scottish Government has no current plans to update the act. We are of course always willing to consider suggestions for legislative change where a persuasive case can be made.

To ask the Scottish Executive how many registrations of potential liability against home owners or landlords have been made with the Keeper of the Land Register for (a) 2005, (b) 2006, (c) 2007 and (d) 2008.
Answer
The number notices of potential liability of costs registered by the Keeper of the Registers of Scotland in the Scottish property registers during the financial years 2005-06 to 2008-09 is set out in the following table. The information is given for both the Land Register of Scotland and the General Register of Sasines.
