Statutory consultees are key stakeholders in the consenting process.

The ‘Verity House Agreement’ and the ‘New Deal for Business’ have set out how the Scottish Government intends to work collaboratively with local authorities and others to deliver a just transition to net zero.

The reform process launched by this consultation creates an opportunity to re-set the expectations on the bodies providing essential support to the application process, taking account of their views, suggestions and their specific circumstances.

The average time for a post mortem examination to take place in Aberdeen is seven days (or five working days) after the post mortem is instructed. Most post mortems are instructed on the same day that the death is reported to COPFS.

The reforms would increase public participation in development proposals at pre application stage. The transparency of the process would remain unchanged. All information relating to applications to build, operate or modify onshore electricity generating stations with capacities exceeding 50 megawatts, as well as all applications to install overhead power lines, large oil and gas pipelines, and associated infrastructure are published and searchable on our Energy Consents website, at https://energyconsents.scot/

There are currently no forensic pathologists based in Aberdeen.

The consultation proposes new standardised processes for both onshore and offshore developers to engage with local communities and stakeholders before applying to the Scottish Government for new energy infrastructure.

At present, the Electricity Act has no provisions that compel developers to notify or consult communities or stakeholders before an application is submitted to Scottish Ministers.

This means the public and communities could remain unaware of proposed projects until an application is submitted.

Many developers do consult communities, but the approach is variable – which undermines public confidence and makes the applications more complex.

The consultation suggests a duty to consult communities and other statutory bodies – such as the planning authority – before an application is made.

It also proposes that a “statement of community consultation” is submitted with an application. This would set out how the public will be able to submit views on the development and how those will be considered in the final application.

The consultation also proposes the submission of a final consultation report setting out the steps taken to engage the public and how those views have been considered.

In October 2022, both Forensic Pathologists working in Aberdeen transferred to other positions in Scotland where they continue to conduct Crown-instructed examinations. COPFS took over management of the pathology services in Aberdeen as Aberdeen University were unable to secure replacement pathologists.

From that date, COPFS has relied on the Forensic postmortem services in other areas of Scotland to provide Forensic specialist cover for Aberdeen, Grampian and the Highlands and Islands.

COPFS is not responsible for recruiting Crown-instructed pathologists.

However, COPFS has investigated alternative options for a forensic pathology service in Aberdeen. In the meantime, continuing with the outsourcing agreement and the use of locum NHS pathologists for non-suspicious post mortem examinations maintains service delivery whilst NHS Grampian progress the establishment of a forensic post mortem service in Aberdeen.

There are currently no part-time forensic pathologists based in Aberdeen. There was one based in Aberdeen until 20 November 2024.

Bereaved relatives are routinely advised of the location of the post mortem examination and the reasons for the transfer.

There are no delays in post mortem examinations affecting legal proceedings in Scotland.

Current forensic pathology service levels in Aberdeen have made no significant impact to the investigation of drug related deaths in Aberdeen.

The majority of post mortem examinations in relation to deaths suspected to be due to the consumption of drugs can be conducted in Aberdeen without any delay.
