Rural Affairs Committee [Draft]

Subordinate Legislation

Meeting date: 23 September 2026

Mark Ruskell

Agenda item 4 is consideration of a negative instrument, which will come into force unless the Parliament agrees a motion to annul it. No such motion has been lodged. The Delegated Powers and Law Reform Committee has made no comment on the instrument. Do members have any comments?

As we have no comments, do members agree that we do not wish to make any recommendations in relation to the instrument?

Members indicated agreement.

I am interested in your analysis of previous public sector reforms, particularly in Wales, where I think that Forestry Commission Wales was brought into Natural Resources Wales. Paul Lowe, what are your thoughts on the benefits, disbenefits and challenges that that brought?

Is this an opportunity to lever more funds into landscape-scale approaches, so that, alongside the mitigation of any impact of an individual development on an area, there are other opportunities for investment? I see that Andy Ford is nodding.

I would like to move us on to the subject of conservation and biodiversity objectives. We have the biodiversity delivery plan, and the Government is to set nature targets, probably next year. I am interested in your analysis of where we are with the conservation of ancient woodlands, Scotland’s rainforest and native woodlands. What are the main challenges in that regard? How do we break those down?

Roxane, did you want to come in?

I am interested in cases when there is a licence application for a significant area of woodland creation but there is tension with surrounding farms, particularly around hefted livestock in upland areas, and the displacement effect that that might have. We talked earlier about the need for negotiation in licensing, and about that being a key role. I am interested in your thoughts on that—how do we manage that transition in our upland landscapes?
