Public Audit Committee [Draft]

“Criminal courts backlog follow-up: Transforming for the future”

Meeting date: 8 October 2026

Dawn Black

I appreciate that. When I talked about “historical” cases, I meant those predating the change as a result of the legislation that came into force in 2010.

Continuing with the same theme, I note that journey times and waiting times are changing across case types, and that is having an impact on differences in patterns between summary and solemn business. Do you have any plans to monitor that impact? As you have said, those long journey and waiting times can have a huge impact on victims, witnesses and accused individuals, with some people perhaps having to wait three years or more. What factors are contributing to that?

I want to ask one final question, if that is okay, convener. I have to say that I find the use of the term “backlog” a little troubling, because it is very negative. After all, there will always be cases working their way through the system. I just wanted to make the point that the reduction in the numbers is a positive thing. Is it possible to change the terminology?

That was really helpful.

You have mentioned some of these issues already, but I would like to do a deeper dive into what is driving the increase in cases coming to the High Courts. You have said that a lot of that is to do with domestic abuse and sexual assault on women and girls. Can you outline the balance between new and historical cases? After all, there seems to be an awful lot of historical cases coming forward.

Do you have anything to add, Mr Graham?

That is good to hear.

Absolutely.

You use demand models, and you have already mentioned that demand will continue to grow even after the increase in capacity next year. Given what is already known about the shape and size of future demand, what assumptions sit behind the projected increases in High Court business, and how do you intend to deal with them?

Rural Support Plan

Meeting date: 7 October 2026

Dawn Black

Good. That is very clear.

On the levels of funding within the four-tier framework, the majority sits within tiers 1 and 2 at the moment. As we move closer to 2030, that will shift to tiers 3 and 4. Nature restoration and climate action fall under tier 3. If we want to encourage those aspects, is there an argument for starting the funding transition a little earlier to ensure that people who are making that journey—and those who are already on it and doing those things—receive the benefit of it?

I am glad to hear that, because there are some really good local market gardens that are doing a lot of good and are contributing to their communities’ local economies. I think that we ought to be looking at the issue of eligibility, but I accept that what happens will be determined by the criteria and how those operations fit into the grand scheme of things.

Pre-budget Scrutiny 2027-28 and Programme for Government

Meeting date: 7 October 2026

I have a quick follow-up question. We have the rural support plan and the rural renewal bill, as well as the Agriculture and Rural Communities (Scotland) Act 2024, which is where this all comes from and which was about supporting rural communities. How do those things marry together?
