Good morning and welcome to the third meeting of the Criminal Justice Committee in session 7, in 2026. I warmly welcome the Cabinet Secretary for Justice and colleagues from the Scottish Government.

Our first item of business today is a decision on whether to take agenda items 6 and 7 in private. Item 6 relates to consideration of the evidence that we are about to hear, and item 7 relates to a supplementary legislative consent memorandum on the Armed Forces Bill. I propose that the committee takes items 6 and 7 in private. Do members agree to do so?

I have one more question before I pass over to colleagues. As someone who is particularly new to this brief, I have been struck by the capacity issues that exist across the prison estate. However, one area that is not at capacity is the open estate at HMP Castle Huntly. Why are we not using the open estate more, particularly for prisoners who might be a bit older or who are less likely to be of risk?
