Transport Committee [Draft]

Procurement

Meeting date: 30 September 2026

I am interested in that point about the other stuff that communities might need from projects. I spend a bit of time going up and down the A9 and big projects are on the go there, with large amounts of kit and resources that are not always fully used. How they use their resources and deploy their equipment is obviously up to the contractors, but at the procurement stage in such a big project, what opportunities could there be? What engagement do you have with, for example, local community groups or even local authorities about projects that they might be looking to undertake in and around that area? When you have a massive project that is bringing in a lot of resources and equipment, what are the opportunities to do some other additional projects alongside it? Would you consider something like that or is that not possible?

Do you have any good examples of where physical works have happened outside of a contract?

So do you not know at the moment whether that is the structure?

I mentioned earlier that there could be other potential customers in an area, such as the local authority or other projects that might arise. Giving better value to another customer that a contractor might be able to engage with could be described as a community benefit. Is there a role in the procurement process for that, or might individual contractors look at the market in an area that they are working in and see what other opportunities might arise?

An approach could also come from the customer side. I gave the example of a local authority, which might approach a contractor that it knows has secured a contract in its area.

Part of the way—so further work would be required.

That links importantly to the timescale, which we heard would be six months maximum. That will be the crucial thing for what the yard and Ferguson’s anticipate and, importantly, for the island communities that are waiting for the vessels. The last time that you were at the committee, Chris Wilcock, we talked about the situation with the Sound of Harris ferry—the Loch Portain—and the urgency with which vessels are in need of replacement. We cannot lose sight of that in this process, too.

Thank you for that clarity—I have no further questions.

Chris Wilcock, do you have anything to add on that? When ports infrastructure is being put in place, there will always be opportunities for other users. A lot of community engagement is involved in the port projects, but does anything in particular jump out at you on this question?

Thank you for joining us. Returning to community benefit, it is clear from what the Transport Scotland officials told us that they put on to contractors quite a bit of the responsibility for identifying options for community benefit and working those into tender submissions. I would be interested to hear any reflections that you might have on that, but it might be more helpful to hear your views on how other customers approach it. You have mentioned the energy sector and Scottish Water. Do other customers approach the issue in a different way? Are there ways in which more impact could be delivered for communities at the contract stage?

I will pursue a point of clarity on the future status of CMAL. You touched on the move from it being a private company owned by the Scottish ministers to being an NDPB. I understand that that is still under review. Will that shift to an NDPB allow for the direct award? Is that the structure that would allow for that?

Okay. What is your feeling at the moment? Do you think that further work will be required?
