Public Audit Committee [Draft]

“Criminal courts backlog follow-up: Transforming for the future”

Meeting date: 8 October 2026

Alan Brown

On the concept of a bottom-up programme and identifying the projects that are required, is that work ongoing or is it done? You are asking for investment from the Scottish Government, and, as far as you are concerned, there has been underinvestment. That suggests to me that you should have a bottom-up programme. You are saying to the Government, “This is what we need—it is over to you.” You have built up the case, and you are saying, “This is what we need to transform our system, make it more efficient and deliver outcomes.” Is that work ongoing, and is it fully costed?

Have you quantified what the increase in journey times through the sheriff and jury system looks like?

If the board is not meeting, how are the updates collated and who takes responsibility for oversight?

I will follow on from that. You said that the summary case management savings are difficult to quantify, because you do not have enough baseline data on similar parameters. Going forward, how will you justify your spend-to-save bids or your submission for the digital platform for the High Court and solemn case system, when you cannot quite quantify the savings from the summary case management system changes? Are you going to be in a position to quantify that more accurately for the next phase of the digital platform?

Even if the election is considered a reason not to meet, that was in May, so why not meet until January 2027?

What was the rationale for it not being supported?

Previously, the Scottish Courts and Tribunals Service said that increasing High Court sittings would be challenging or difficult within the existing budget and that it was exploring whether it would be possible to redirect resources from other priorities. Have you found the money from within the existing budget, and, if so, has that come at the expense of other priorities? If so, what priorities have slipped?

Public Office (Accountability) Bill

If I put a finance hat on—rather than a public administration hat—is it correct that there are no direct financial consequences of the LCM and that the only indirect financial consequences would relate to the cost of access to legal aid in those circumstances?

I have a small question about something that was touched on in the opening remarks. Is it correct that the changes to legal aid provision are solely for fatal accident inquiries? Is it just to provide greater access to legal support for family members of the deceased, if they have to participate?
