Public Audit Committee [Draft]

“Criminal courts backlog follow-up: Transforming for the future”

Meeting date: 8 October 2026

Alan Brown

The report says that there are, in effect, two oversight boards for the change programmes. One is the justice efficiencies and effectiveness collaboration group, which had an initial meeting in August 2025, but the report says that it was not formalised and has not met since. The other is the criminal justice programme board, but the report says that it has not met since July 2024. Is that still the case?

I am thinking about the budget process. It seems to me that, in the background, you should be well down that road, given the deadlines.

Okay. I will switch tack slightly. The new sexual offences court was mentioned earlier. The report highlighted that the SCTS says that it will need additional support to implement that, so has the resource to set the court up now been identified? Is the resource in place and is there a timeline for the court coming online, or is that still up for debate?

Have you quantified what is required?

You say that you do not want to be pinned down and give a timescale, Mr Graham, but are we talking about the court being operational within the budget year if the money is allocated? Are we talking about the next year beyond that? You must be able to give a plus-or-minus range for timescales.

A lot of your evidence today has been about underfunding from the Scottish Government. If you are talking about underfunding, you must be quantifying what is required. To be honest, I cannot understand why it is not fully quantified at this stage. Do you have anything to add on that?

Mr Graham, I am not sure whether I picked this up correctly, so I apologise if I did not. When you talked about a lack of investment, I think that you said that you wanted to implement a programme that is built from the bottom up. Did I pick that up correctly? Are you saying that the funds are not available to do the bottom-up programme and to lead transformation in that way?

It still seems that you are saying that you do not have the resource to do the bottom-up programme. You surely need to find or ask for the resource to do the bottom-up work, so that it is not reliant on stand-alone bids. The Government should see that this should be a series of interlinked projects; it should not be a stand-alone bid here and a stand-alone bid there.

Will that positive trajectory continue, or will it plateau, given what we have just discussed?

I am trying to get a handle on when the resource allocation requirement will be fully understood, quantified and submitted as part of the budget process, if we want to see the new sexual offences court up and running.
