Legislative Consent Memorandum on Professional Qualifications Bill

Letter from the Convener to Minister for Business, Trade, Tourism and Enterprise, 27 September 2021


Dear Minister,

At the meeting of the Delegated Powers and Law Reform Committee on 21 September, the Committee considered the delegated powers relevant to Scotland in the Professional Qualifications Bill (“the Bill”) as referred to in the Legislative Consent Memorandum lodged by the Scottish Government on 12 July 2021.  The Committee subsequently published its report on these powers. The Committee also agreed to write to you in relation to which regulated professions are within the scope of the Bill.

The Committee noted that the UK Government’s Explanatory Notes on the Bill states that:

 “In the UK there are over 160 professions that are regulated by legislation by a network of more than 50 regulators, in addition to a range of other professions regulated voluntarily.”

However, the list of professions and regulators do not appear to be listed in any of the Bill’s accompanying documents.

Given the scope of the Bill’s delegated powers is affected by which professions and regulators are covered by the proposed legislation, I would be grateful if you could provide a list of all professions and regulators which are covered by the Bill.

I would be grateful if you were able to provide a response by Monday 18 October 2021.
