Delegated Powers and Law Reform Committee 26 June 2018

Agenda: Decision on Taking Business in Private, Instruments subject to Affirmative Procedure, Instruments subject to Negative Procedure, Instruments not subject to Parliamentary Procedure

Instruments subject to Negative Procedure

Tuberculosis (Miscellaneous Amendments) (Scotland) Revocation Order 2018 (SSI 2018/202)

The Convener

The first instrument for consideration under agenda item 3 is SSI 2018/202, which was laid before the Parliament on 22 June and comes into force on 30 June, so it does not respect the requirement that at least 28 days should elapse between the laying of an instrument that is subject to the negative procedure and its coming into force.

Does the committee wish to draw the order to the attention of the Parliament on reporting ground (j), as it fails to comply with the requirements of section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010?

Members indicated agreement.

The Convener

Does the committee wish to find the failure to comply with section 28(2) of the 2010 act to be acceptable in the circumstances, as set out in a letter to the Presiding Officer of 22 June?

Members indicated agreement.

Legal Aid (Employment of Solicitors) (Scotland) Amendment Regulations 2018 (SSI 2018/193)

The Convener

No points have been raised on the instrument. Is the committee content with it?

Members indicated agreement.
