The First-tier Tribunal for Scotland Social Security Chamber and Upper Tribunal for Scotland (Composition) Regulations 2018 [draft]

The Committee reports to the Parliament as follows—

  1. The First-tier Tribunal for Scotland Social Security Chamber and Upper Tribunal for Scotland (Composition) Regulations 2018 [draft] was laid before the Parliament on 10 October 2018 and referred to the Social Security Committee.

  1. The First-tier Tribunal for Scotland Social Security Chamber and Upper Tribunal for Scotland (Composition) Regulations 2018 [draft] is subject to the affirmative procedure (Rule 10.6). It is for the Social Security Committee to recommend to Parliament whether the Regulations should be approved.

  1. This instrument forms part of a set of instruments, which when taken together, amend the First-tier Tribunal for Scotland (Chambers) Regulations 2016 and provide for the division of the First-tier Tribunal for Scotland into chambers. A new chamber is brought into being, to be known as the First-tier Tribunal for Scotland Social Security Chamber. This new Chamber will enable decisions of Social Security Scotland to be challenged to an independent body.

  1. The Delegated Powers and Law Reform Committee considered this instrument at its meeting on 23 October 2018 and agreed that it did not need to draw it to the attention of the Parliament.

  1. At the meeting on 1 November, Shirley-Anne Somerville, Cabinet Secretary for Social Security and Older People moved motion S5M-14434.

    That the Social Security Committee recommends that the First-tier Tribunal for Scotland Social Security Chamber and Upper Tribunal for Scotland (Composition) Regulations 2018 [draft] be approved.

    The motion was agreed to without division.
