  1. To inform the Committee’s consideration of the COVID-19 health protection travel regulations it held an evidence session on Tuesday 2 March 2021 with—

The Health Protection (Coronavirus) (International Travel) (Managed Accommodation and Testing) (Scotland) Regulations 2021 (SSI 2021/74)

  1. The Health Protection (Coronavirus) (International Travel) (Managed Accommodation and Testing) (Scotland) Regulations 2021 (SSI 2021/74) were laid before the Parliament on 15 February 2021 and referred to the Health and Sport Committee.

  1. They are laid under section 94(1) (International Travel) of the Public Health etc. (Scotland) Act 2008. Section 122(5) of the 2008 Act states that regulations under section 94(1) are subject to the affirmative procedure. However, section 122(6) provides that the affirmative procedure will not apply if the Scottish Ministers consider that the regulations need to be made urgently. In such situations section 122(7) applies.

  1. At its meeting on 2 March 2021, the Delegated Powers and Law Reform Committee considered the instrument and determined that it did need to draw the instrument to the attention of the Parliament.

    The Committee agreed to draw this instrument to the attention of the Parliament on reporting ground (i) - that the instrument’s drafting appears to be defective, in relation to new regulation 5J(1)(c) and new regulation 5J(3)(d).

    The Committee notes the Scottish Government has since legislated to correct these errors.

  1. It is for the Health and Sport Committee to recommend to the Parliament whether the Regulations should be approved.

  1. The Cabinet Secretary for Transport, Infrastructure and Connectivity, Michael Matheson MSP, has, by motion S5M-24146, proposed that the Committee recommends approval of the Regulations.

  1. At its meeting on 9 March 2021, the Committee took evidence on The Health Protection (Coronavirus) (International Travel) (Managed Accommodation and Testing) (Scotland) Regulations 2021 (SSI 2021/74) from—

    That the Health and Sport Committee recommends that The Health Protection (Coronavirus) (International Travel) (Managed Accommodation and Testing) (Scotland) Regulations 2021 (SSI 2021/74) be approved.

The Health Protection (Coronavirus) (International Travel) (Scotland) Amendment (No. 6) Regulations 2021 (SSI 2021/81)

  1. The Health Protection (Coronavirus) (International Travel) (Scotland) Amendment (No. 6) Regulations 2021 (SSI 2021/81) were laid before the Parliament on 18 February 2021 and referred to the Health and Sport Committee.

  1. They are laid under section 94(1) (International Travel) of the Public Health etc. (Scotland) Act 2008. Section 122(5) of the 2008 Act states that regulations under section 94(1) are subject to the affirmative procedure. However, section 122(6) provides that the affirmative procedure will not apply if the Scottish Ministers consider that the regulations need to be made urgently. In such situations section 122(7) applies.

  1. At its meeting on 2 March 2021, the Delegated Powers and Law Reform Committee considered the instrument and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.

  1. It is for the Health and Sport Committee to recommend to the Parliament whether the Regulations should be approved.

  1. The Cabinet Secretary for Transport, Infrastructure and Connectivity, Michael Matheson MSP, has, by motion S5M-24189, proposed that the Committee recommends approval of the Regulations.
