The Human Tissue (Excepted Body Parts) (Scotland) Regulations 2020 [draft]

  1. The Human Tissue (Excepted Body Parts) (Scotland) Regulations 2020 [draft] were laid before the Parliament on 23 September 2020 and referred to the Health and Sport Committee.

  1. The Regulations are subject to the affirmative procedure (Rule 10.6).

  1. At its meeting on 29 September 2020, the Delegated Powers and Law Reform Committee considered the instrument and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.

  1. It is for the Health and Sport Committee to recommend to the Parliament whether the regulations should be approved.

  1. The Minister for Public Health, Sport and Wellbeing has, by motion S5M-22821, proposed that the Committee recommends the approval of the Regulations.

  1. At its meeting on the 27 October 2020, the Committee took evidence on the Human Tissue (Excepted Body Parts) (Scotland) Regulations 2020 [draft] from—

    • Joe FitzPatrick, Minister for Public Health, Sport and Wellbeing;

    • Gemma Grant, Lawyer, Scottish Government Legal Directorate; and

    • Sharon Grant, Team Lead, Implementation of the Human Tissue (Authorisation)(s) Act 2019, Scottish Government.

  1. Following the evidence session, Joe FitzPatrick moved motion S5M-22821

    That the Health and Sport Committee recommends that the Human Tissue (Excepted Body Parts) (Scotland) Regulations 2020 [draft] be approved.

  1. The motion was agreed to.
