Power of Attorney

That the Parliament notes that, in Scotland, if a person is incapable of managing their property, finances or of making decisions regarding their welfare, the Adults with Incapacity (Scotland) Act 2000 provides protection for them; understands the importance of Power of Attorney as a method of advance planning in the event that someone is unable to make such decisions about themselves; notes the calls to encourage and promote awareness campaigns to inform everyone over 16 in the West Scotland region and across the country about the benefits of setting up a Power of Attorney; further notes the awareness campaigns targeting health and social care professionals to allow them to develop a good understanding of what Power of Attorney is and its relevance in health and social care settings, and understands that if no Power of Attorney in place, the process of applying for a guardianship order can be very stressful, emotionally demanding and potentially expensive, with ongoing, onerous, reporting requirements.
