Scottish Courts Rule on UK Parliament Suspension

  • Submitted by: Emma Harper, South Scotland, Scottish National Party.
  • Date lodged: Thursday, 12 September 2019
  • Motion reference: S5M-18839

That the Parliament welcomes the Scottish Court of Session’s judgement that concluded that the UK Government acted unlawfully by proroguing (suspending) the UK Parliament; notes that the case was heard at appeal by the Inner House, the Supreme Civil Court in Scotland, which ruled that the actions of the UK Government failed to comply with generally accepted standards of behaviour of public authorities; agrees with the court in its assertion that, by proroguing the UK Parliament, the UK Government is preventing or impeding the ability of Parliament to hold the executive to account in actions relating to the UK’s withdrawal from the EU, and congratulates the dedicated legal team, with input from the lead petitioner, Joanna Cherry QC MP, and all other politicians who have worked tirelessly to secure the hearing of this case, and to secure an outcome that it considers aims to preserve democracy, parliamentary scrutiny and the power of Parliament in the UK.
