To ask the Scottish Government, in light of the the undertaking given by the Scottish Qualifications Authority (SQA) and accepted by Ofqual on 16 August 2024, whether it is aware of the concerns identified by Ofqual in January 2022 regarding the SQA's approach to investigating and dealing with with malpractice and maladministration concerns and. if so. what whose concerns were.
Answer
Ofqual regulates qualifications, examinations and assessments in England. It’s findings relate to the SQA Level 1 Health and Safety in a Construction Environment qualification delivered in England which was withdrawn by SQA in April 2019.
SQA have regularly updated the Scottish Government on the Ofqual review from its inception.
Ofqual has published its findings: Undertaking given by Scottish Qualifications Authority to Ofqual in accordance with B8 of the Conditions of Recognition - GOV.UK (www.gov.uk).

To ask the Scottish Government whether it can provide an update on its commitment to establish a pilot scheme in secondary schools for the delivery of universal free school meals, in light of research research published by NASUWT, which suggested that 21% of secondary school teachers are using money from the Pupil Equity Fund to buy school meals for children coming to school hungry,
Answer
The Scottish Government remains committed to tackling the child-poverty related attainment gap and is already ensuring eligible pupils in Secondary 1 to Secondary 6 can receive free school meals.
Local authorities issue specific complementary guidance about how Pupil Equity Funding operates locally. This varies across Local Authorities and is designed to provide targeted support for children and young people affected by poverty to achieve their full potential. Headteachers have the flexibility to use this funding to help support children in their schools to close the poverty related attainment gap.
In light of the challenging financial context, we have been clear that our initial focus will be on expanding Free School Meals to Primary 6 and 7 pupils who are in receipt of the Scottish Child Payment, which will be delivered in this Parliament.

To ask the Scottish Government what discussions it has had with the Net Zero Technology Centre about future funding after the Aberdeen City Region Deal funding stream concludes.

Scottish Government officials meet quarterly with the Net Zero Technology Centre to discuss a variety of financial matters, including the Centre's plans for future funding beyond the term of the Aberdeen City Region Deal and its journey towards financial self sustainability. Officials will continue to meet with the Centre to discuss these matters for the remainder of the Deal period.

I can advise that South of Scotland Enterprise (SOSE) are working closely with Bhagat Holdings in regard to the former Pinneys Site in Annan.

To ask the Scottish Government how many (a) employers and (b) workplaces are monitored by the Agricultural Wages Enforcement Team.
Answer
All agricultural businesses that have employees are required to comply with the Agricultural Wages (Scotland) Order (AWO). The monitoring of compliance with the AWO takes the form of Control Test Inspection (CTIs). Each year, a selection of 120 businesses, encompassing employers and workplaces, are randomly selected from the information taken from the June Scottish Agricultural Census. In 2024, circa 8200 businesses were deemed to have employees covered by the AWO. In addition to CTIs, the Agricultural Wages Enforcement Team will investigate all businesses where employees have raised complaints.

To ask the Scottish Government how many agricultural wages inspectors are (a) directly employed by it and (b) independent contractors.
Answer
There are currently 21 Scottish Government employees working as Agricultural Wage Inspectors. This role is conducted by Agricultural Officers who work for Rural Payments & Inspections Division and are responsible for other statutory functions in addition to agricultural wages inspections.
No independent contractors conduct the role of Agricultural Wages Inspector on behalf of the Scottish Government.

To ask the Scottish Government how many enforcement notices have been issued by the Agricultural Wages Enforcement Team in each of the last five years.

Total number of Enforcement Notices issued by the Agricultural Wages Enforcement Team in each of the last 5 years:
2020: 16
2021: 0
2022: 3
2023: 8
2024: 13
Enforcement Notices (ENs) are issued as a result of non-compliance with AWET correspondence. If an underpayment has been identified as a result of a wages inspection or complaint, ENs are used if an Employer fails to fulfil a request for payment. These act as the end of deliberation between the Employer and AWET, and now form a legal requirement for the Employer to provide reimbursement to an Employee.
Any further objection to the contents of an EN may now only be challenged via Employment Tribunal or an agreed settlement.
