National Health Service Superannuation Scheme (Miscellaneous Amendments) (Scotland) Regulations 2017 (SSI 2017/27)

Good morning and welcome to the seventh meeting in 2017 of the Health and Sport Committee. I ask everyone in the room to set their mobiles to silent, and I also remind all present that, although it is acceptable to use mobile devices for social media purposes in the room, photographs should not be taken and the proceedings should not be filmed.

Agenda item 1 is consideration of two Scottish statutory instruments that are subject to negative procedure. On the National Health Service Superannuation Scheme (Miscellaneous Amendments) (Scotland) Regulations 2017 (SSI 2017/27), no motion to annul has been lodged, but the Delegated Powers and Law Reform Committee has drawn the regulations to the Parliament’s attention on reporting ground (i), as regulation 1(2) appears to be defectively drafted. In accordance with the Scottish Government’s intention, regulation 1(2) should have provided that regulations 31 and 40 have retrospective effect from 6 April 2016, rather than coming into force on 13 March 2017. However, the Delegated Powers and Law Reform Committee welcomes the Scottish Government’s undertaking to make the necessary amendment to provide for that retrospective effect when the National Health Service Superannuation Scheme (2008 Section) (Scotland) Regulations 2013 (SSI 2013/174) are next amended. National Health Service Pension Scheme (Scotland) (Miscellaneous Amendments) Regulations 2017 (SSI 2017/28)

No motion to annul the National Health Service Superannuation Scheme (Miscellaneous Amendments) (Scotland) Regulations 2017 (SSI 2017/28) has been lodged, and the Delegated Powers and Law Reform Committee has made no comments.
