Subordinate legislation considered by the Social Security Committee on 5 March 2020

The First-tier Tribunal for Scotland Social Security Chamber (Procedure and Allocation of Functions) Amendment Regulations 2020 [draft]

  1. The First-tier Tribunal for Scotland Social Security Chamber (Procedure and Allocation of Functions) Amendment Regulations 2020 [draft] was laid before the Parliament on 29 January 2020 and referred to the Social Security Committee.

  1. The Instrument is subject to the affirmative procedure (Rule 10.6) and it is for the Social Security Committee to recommend to Parliament whether the Instrument should be approved.

  1. The instrument amends two sets of Regulations relating to the handling of appeals by the Social Security Chamber of the First-tier Tribunal for Scotland. The instrument:

    • extends the period of assignment for the acting Social Security Chamber President

    • makes procedure rule changes, some to clarify the intent of the original drafting and others to address more substantive points.

  1. The Delegated Powers and Law Reform Committee considered the Regulations at its meeting on 18 February 2020 and did not raise any issues.

  1. Following the evidence session, Shirley-Anne Somerville moved motion S5M-20851

    That the Social Security Committee recommends that the First-tier Tribunal for Scotland Social Security Chamber (Procedure and Allocation of Functions) Amendment Regulations 2020 [draft] be approved.

    The motion was agreed to without division.

The Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 [draft]

  1. The Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 [draft] was laid before the Parliament on 31 January 2020 and referred to the Social Security Committee.

  1. The Instrument is subject to the affirmative procedure (Rule 10.6) and it is for the Social Security Committee to recommend to Parliament whether the Instrument should be approved.

  1. These Regulations set the Scottish Government’s Advocacy Service Standards as required by Section 11(2) of the Social Security (Scotland) Act 2018.

    These set out the standards required for the independent advocacy support that the Scottish Government will provide to a person interacting with Scottish social security system.

  1. The Delegated Powers and Law Reform Committee considered the Regulations at its meeting on 25 February 2020 and did not raise any issues.

  1. Following the evidence session, Shirley-Anne Somerville moved motion S5M-21021

    That the Social Security Committee recommends that the Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 [draft] be approved.

    The motion was agreed to without division.
