Report on the Community Empowerment (Scotland) Act 2015 (Supplementary and Consequential Provisions) Order 2018 [draft]

Introduction

  1. The Local Government and Communities Committee reports to the Parliament as follows—

  1. The Community Empowerment (Scotland) Act 2015 (Supplementary and Consequential Provisions) Order 2018 [draft] was laid before the Parliament on 21 December 2017 and referred to the Local Government and Communities Committee for consideration.

  1. This instrument is subject to affirmative procedure (Rule 10.6) and it is for this Committee to recommend to the Parliament whether the Regulations should be approved.

  1. This Order makes provision that is supplementary to and in consequence of Part 9 (allotments) of the Community Empowerment (Scotland) Act 2015.


Consideration by committees

  1. The Delegated Powers and Law Reform Committee considered this instrument at its meeting on 16 January 2018 and determined that it did not need to draw the attention of the Parliament to the instrument on any grounds within its remit.

  1. At its meeting on 24 January 2018, the Local Government and Communities Committee took evidence from—

    Roseanna Cunningham MSP, Cabinet Secretary for Environment, Climate Change and Land Reform, Robin MacLean, Policy Officer, Food, Drink and Trade Division, and Judith Brown, Solicitor, Scottish Government.

  1. Following the evidence session, Roseanna Cunningham MSP moved motion S5M-09989—

    That the Local Government and Communities Committee recommends that the Community Empowerment (Scotland) Act 2015 (Supplementary and Consequential Provisions) Order 2018 [draft] be approved.

    The motion was agreed to without division.
